There are so many families who have expected to benefit from an estate having believed the myths about being a common law husband/wife only to find that they do not inherit anything.  Or, the fact that many families are part of a second marriage, and the children from the first marriage do not inherit anything due to being 'sideways disinherited'.  Sideways disinheritance is the phrase used to describe when children, often unintentionally, end up losing out on their share of their parents' estate due to remarriage.  If you pass away, your property generally passes straight to your spouse, so they own all the assets.  Should your surviving spouse then remarry, any previous Will would be invalid, and after the new marriage, should your surviving spouse pass away before their new spouse, then any property usually transfers to their new spouse.  This could mean that the assets that you wanted to go to your children after your partner's passing could go to a complete stranger, and your children do not inherit any of your estate.  At DeClare, we want to raise this awareness and help families to include particular trusts and clauses within their Wills which will ensure that assets are reserved for their loved ones.
